The European Procurement Directives have obliged Germany to grant primary legal protection in Europe-wide awards.

Pursuant to §§ 155 et seq. GWB, for public contracts awarded throughout Europe there is the possibility of obtaining legal protection through a so-called review procedure. This review procedure is subdivided into a procedure before the public procurement tribunal as first instance and in a procedure before the procurement senate of the higher regional court as second instance. First and only judicial authority is therefore the respective OLG, for awarding decisions of the Federal Cartel Office as the awarding Chamber of the Federal Higher Regional Court Düsseldorf. Separate OLGs have completely different jurisdiction.
